NEW YORK – On December 22, 2016, the New York Court of Appeals held in People v. Bridgeforth that skin color-based discrimination in jury selection is prohibited under Batson v. Kentucky, the New York State Equal Protection Clause, and the New York State Civil Rights Law. While Batson has long been understood to prohibit racial discrimination, the Court concluded that its holding “extend[s] the application of Batson to challenges based on color to ensure that the jury is not used as a tool to accomplish such discrimination.” As one of many community organizations that co-signed the Fred T. Korematsu Center for Law and Equality (“Korematsu Center”) and Akin Gump’s amicus brief in support of this decision, the Asian American Bar Association of New York (“AABANY”) applauds this decision.

Joane Wong, Co-Chair of the AABANY Labor & Employment Law Committee, recently received a positive decision in a case that she tried on behalf of the General Counsel of the National Labor Relations Board (NLRB) in January 2016. The NLRB affirmed the rulings of the Administrative Law Judge against East Village Grand Sichuan Inc. d/b/a Grand Sichuan Restaurant. The case involved allegations by one of the employees of the restaurant being discharged for engaging in protected activity, i.e., filing a suit against her employer for violating the Fair Labor Standards Act and New York Labor Law.
Congratulations to Labor & Employment Law Committee Co-Chair Joane Wong for success in her trial and having the results affirmed by the NLRB.

Thanks to the hard work of our Pro Bono & Community Service Committee, AABANY started its first monthly pro bono clinic in 2015. This free legal clinic takes place the second Wednesday of every month at a new location. Stay tuned for more details.

AALFNY's 2017 Community Service Scholarship: Applications are available here, and must be postmarked by March 31, 2017.
Up to three scholarships of $5,000 each will be awarded to law students with a demonstrated commitment to serving the Asian American community and who will be interning with a non-profit organization or governmental agency that is involved with the Asian American community in NY (see application for more details).

Judge seeks volunteer attorneys/law grads with experience in criminal, landlord-tenant or consumer debt matters. Judge presides on appellate cases and also handles some civil Supreme Court matters.
Full-time or four days per week preferred, but flexible schedule can be arranged. A wonderful learning and mentee opportunity, as well as an excellent resume-enhancer. Although not guaranteed, many of former volunteers have moved onto paying legal positions. Opportunity to enhance research/writing and oral skills.
Willing to fill out paperwork for paid fellowships, if necessary. Rolling deadline. Opportunities open year round.
