Discovery and Investigations in China CLE, Jan. 24

Please join the Litigation Committee for Discovery and Investigations, a CLE event with two panels of experts, co-sponsored with Fordham Law, Consilio, and the Chinese Business Lawyers Association. This event will take place on January 24, 2017 from 6:30pm to 9pm in the Costantino Room - Second Floor at Fordham Law School (150 W 62nd Street).

Document collection and discovery has become an increasingly important and fraught issue in China. U.S. litigations often require the collection and review of documents in China in ways that conflict with Chinese laws, such as laws on state secrecy and financial privacy. How can discovery be conducted in China while avoiding legal, financial, and ethical problems? And what about internal investigations, which often require reviews of sensitive documents and materials, which may also implicate Chinese laws and regulations? This event will discuss the challenges and solutions in both internal investigations in China and also document discovery in China as part of U.S. litigations.

RSVP to events@cblalaw.org.

Thank You to Eve Guillergan for Serving as a New York Elector

We would like to recognize the great work by one of our prominent members, Eve Guillergan, who served as a member for the Electoral College of New York during the 2016 election. Appointed by Democratic Party officials, she was one of 29 delegates pledged to Hillary Rodham Clinton. It is a considered a huge honor to be selected as a private citizen as most of the electors are elected officials. Eve was the only APA elector in Albany during this momentous occasion and may be the first Korean or Filipino elector in New York State history.

The 538 members of the electoral college nationwide met and voted for President and Vice President on December 19, 2016. The New York electoral college met at the State Capitol building in Albany. Eve served as an elector alongside President Bill Clinton, Governor Andrew Cuomo, NYC Mayor Bill DeBlasio, Public Advocate Letitia James, mayors of Albany and Buffalo, and more. Each of New York’s 29 electors cast paper ballots for president and vice president. The electors deposited their ballots one by one into wooden ballot boxes in the Senate chamber. New York’s 29 electors unanimously voted for Hillary Clinton and Tim Kaine. There was a ceremonial process of proceedings that was overseen by Governor Andrew Cuomo.

LGBT Committee Chair Glenn Magpantay Featured on The Huffington Post

Our LGBT Committee Co-Chair Glenn Magpantay has been featured in The Huffington Post, giving advice about precautions to take before Trump takes office. As always, we thank him for his expert advice and the great work he does with the National Queer Asian Pacific Islander Alliance. He touches on immigration, Obamacare, same-sex marriage and more in this article.

There are a number of measures that LGBT Asian Americans, South Asians, Southeast Asians, and Pacific Islanders should do to protect themselves and their families under a Trump Administration. I’m a civil rights lawyer by practice and I’ve consulted with other immigration attorneys, public policy experts, and other practitioners to identify issues of particular importance for our community.

Many of these applications will not be granted until after Trump takes office. But even if Trump tries to eliminate everything that we have won, it is virtually impossible for changes to be retroactive. Applications filed today will be decided and granted on the basis of the laws and rules while Obama is in office. So take care of these soon.
