Topics of Discussion:

Workplace discrimination on the basis of race and national origin has remained a focal point for the US Equal Employment Opportunity Commission since its inception. Both race and national origin discrimination are pillars of Title VII of the Civil Rights Act of 1964 and continue to remain prevalent issues in the workplace. Many modern day cases reflect new and evolved methods of race discrimination that are equally insidious as the tactics of the past. One such example is the increase in employers' reliance on criminal conviction data as a means of excluding potential employees from job opportunities where the applicants might otherwise be qualified. This panel will provide an overview of our published guidance on this point while also discussing some of our most recent race-based cases and the agency's approach to the issues involved. Additionally, an EEOC investigator will present a step-by-step guide of the do's and don'ts for drafting and submitting an EEOC Charge of Discrimination, detailing what things investigators look for when reviewing charges.
