On May 20, the American Arbitration
Association will present the next installment in its ongoing series of legal
update webinars. Developments in Arbitration Law – Testing the
Boundaries of Court Intervention webinar will explore some of the issues
that can create tensions when parties seek to have courts intervene in the
arbitration process. The legal update will be presented by AAA General
Counsel Eric P. Tuchmann and attorney/arbitrator/ mediator Theodore K. Cheng,
who is an AAA Board Nominee and 2013 Higginbotham Fellow.
The period of time and the
circumstances in which a court may become involved in an arbitration depend on
a number of factors. Many courts have clearly delineated the limited role
courts play in the arbitration process. However, certain issues arise with
greater frequency that test the boundaries of the courts’ role. The outcomes of
some of these challenges can have significant consequences for an arbitration
proceeding or the enforceability of an award.
