The geopolitical environment between the U.S. and China is creating ripple effects for businesses operating in China. Multinational corporations, already under heavy compliance pressures in multiple jurisdictions, are now facing additional challenges as China flexes its enforcement muscles in a number of compliance areas. 
  
Particularly, Chinese regulators have been intensifying their scrutiny in areas such as data security, anti-trust, anti-bribery and anti-corruption, and China’s state secrets law. Recently enacted restrictions on the movement of currency have also impacted multinational operations in China by disrupting fund flows, increasing risks of exposure to money-laundering for all businesses moving capital globally, as well as cross border M&A activities. 
  
This briefing will cover how these developments may affect your company, and how to prepare and protect your business operations in China. Discussion topics will include:

  • Stricter anti-bribery and anti-corruption laws as part of the Chinese government’s anti-graft campaign, aiming at both the private sector bribe givers and government official bribe takers
    Enforcement of anti-trust laws against multinational corporations
  • Data security laws that impact the moving of data out of China (e.g., state secrecy laws) as well as the collection of certain private information, which can impact companies seeking to conduct investigations in China
  • Recently enacted currency restrictions that limit the amount of money companies can move out of China without prior approval to $5 million
