Favorable views from the public of the Supreme Court of the United States remain near a historic low, with a poll indicating
that overall confidence in the American judicial system declining more than any other civic institution. Do these trends suggest that Supreme Court reform is needed, in part, to restore credibility in our legal system? While perceptions
may often align with party affiliation, after mounting criticism over perceived ethical lapses, the Supreme Court in late 2023 finally adopted its own code of ethics, something that all lower courts have had for decades. In 2024, NAPABA
called for an effective mechanism to ensure that any such code for the Supreme Court be enforceable. Meanwhile, proposals like term limits, increasing the size of the Court, and others have again surfaced, prompting ongoing discussion
over whether or how reform should proceed. These questions reside at the heart of whether the Court is a neutral umpire, as Chief Justice Roberts has famously claimed, or if it acts instead as the highest policy making body in the land.
Join NAPABA for a thought-provoking conversation with leading experts as we explore the contours of possible Supreme Court reform to improve the functioning and perception of the nation's highest court. This program is approved
for 1.0 hour of general CLE credit in Pennsylvania; credit may qualify elsewhere. Please check your jurisdiction’s reciprocity rules.
When: Wednesday. January 28, 2026, 5pm - 7pm Where: Rutgers Law School - Newark Room 125, 123 Washington Street, Newark, New Jersey 07102
Inspired by Prof. Rose Cuison Villazor’s law review article, “Rediscovering Oyama v. California: At the Intersection of Property, Race, and Citizenship,” 87 Wash. U. L. Rev. 979 (2010), the reenactment deals with the California Alien Land
Law which prevented “aliens ineligible from citizenship” – i.e., Japanese – from owning land. The case explored the ways in which denial of property rights also served to promote racial discrimination against the Japanese in California.
In the case, Kajiro Oyama, a Japanese immigrant who was ineligible for United States citizenship at the time, bought a parcel of farm land which he deeded to his minor son Fred, who was born in the United States and was thus a citizen.
Under the Alien Land Laws, this transaction was deemed a fraud and the State of California brought suit against Fred Oyama to escheat the property. The case went all the way up to the United States Supreme Court, where the statute’s
constitutionality was placed before the Court for its review.
Using actual trial transcripts and a reconstruction of the argument before the United States Supreme Court, illustrated with photos from the time, this reenactment
brought back to life an important but nearly forgotten case in the annals of the civil rights struggle in the United States and the part played by Asian Americans in that movement. The doctrines and alliances formed in litigating the
Oyama case laid the groundwork for later cases that dealt with equal rights and equal treatment under the law, including Brown v. Board of Education.
